You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are between 13 and 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

When you submit a report, photo, or any other content through the Service ("User Content"), you retain ownership of that content. However, by submitting it, you grant MyCity311 a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and distribute your User Content for the purpose of operating and improving the Service.

MyCity311 is not affiliated with, endorsed by, or acting on behalf of any city, county, state, or federal government agency, unless explicitly stated for a specific city partnership. Submitting a report through MyCity311 does not guarantee that your report will be received, reviewed, or acted upon by any government authority. For official city service requests, please use your city's official 311 system or government website.
The Service and its original content, features, and functionality are owned by MyCity311 and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
The Service may integrate with or link to third-party services, including mapping providers and cloud platforms. Your use of those services is governed by their respective terms and privacy policies. MyCity311 is not responsible for the content or practices of any third-party services.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; REPORTS SUBMITTED WILL BE RECEIVED OR ACTED UPON BY ANY GOVERNMENT ENTITY; THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS; OR ANY DEFECTS WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYCITY311 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED $100.
You agree to indemnify and hold harmless MyCity311 and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Service or violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Prince George's County, Maryland. The Service is operated by Red Derby Ventures LLC, a Maryland limited liability company (EIN: 41-5369939), located at 6707 40th Ave, University Park, MD 20782.
Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and MyCity311 regarding the Service and supersede all prior agreements.
